Copyright & Intellectual Property (DMCA) Policy
PhyTu respects intellectual-property rights and expects its users to do the same. This policy explains how to report content on the marketplace that you believe infringes your copyright or other IP rights, and how a user whose content was removed can respond.
1. User-Uploaded Content
Listings, photographs, descriptions, and other content are uploaded by independent users. By uploading content, a user represents that they own it or have the necessary rights and permissions. PhyTu does not pre-screen all content but will act on valid notices as described below.
2. Reporting Alleged Infringement (Takedown Notice)
If you believe content on PhyTu infringes a copyright or other IP right you own or represent, send a written notice to our designated agent at info@phytu.com that includes:
- Your physical or electronic signature (or that of an authorized agent);
- Identification of the copyrighted work or other right claimed to be infringed;
- Identification of the material claimed to be infringing and enough information to locate it on the Site (such as the listing URL);
- Your contact information (name, address, telephone, email);
- A statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law; and
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.
Please send only accurate, good-faith notices. Under U.S. law, a person who knowingly materially misrepresents that material is infringing may be liable for damages.
3. Our Response
Upon receiving a valid notice, PhyTu may remove or disable access to the material, notify the user who posted it, and, for repeat infringers, suspend or terminate the account.
4. Counter-Notice
If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice to info@phytu.com that includes:
- Your physical or electronic signature;
- Identification of the removed material and the location where it appeared before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the complaining party.
Where required by law, PhyTu may restore removed material after a valid counter-notice unless the complaining party notifies us that it has filed a legal action.
5. Repeat Infringers
PhyTu will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.
6. Trademarks and Other Rights
Reports of trademark, publicity, or other IP concerns may be sent to the same address with equivalent detail. PhyTu reviews and acts on valid concerns at its reasonable discretion.
